Terms of Service

These Terms of Service are the agreement between you and us for using Alyona. Please read them: by creating an account or using Alyona, you accept them.
1. Who we are
Alyona is operated by Alyona LTD., Ockershauser Allee 8, Marburg, Germany (“Alyona”, “we”, “us”). You can reach us at legal@alyona.io.
2. Who can use Alyona
You must be at least 18 years old to use Alyona. When you sign up we ask for your date of birth; if it shows you are under 18, we close the account and you can’t sign in again with it. Your date of birth can’t be changed later, so please enter it correctly.
You may only create an account for yourself, and you may not use Alyona where the law doesn’t allow it.
3. Your account
- You sign in with a third-party provider (currently Google). Keep that account secure — anything done through your Alyona account is your responsibility.
- Your profile is reachable at /@username. Your display name, username, bio, avatar, the tracks you create and the tracks you like are visible to other signed-in members. See our Privacy Policy.
- Choose a username that doesn’t impersonate anyone or infringe anyone’s rights. We may change or reclaim usernames that do.
4. How Alyona works
When you describe the music you want and press Create, Alyona picks the track from its music library that best matches your description and adds it to your account as your creation, credited to your username. The model name shown with a creation (for example “V5”) identifies the version of Create it was made with.
Tracks come from Alyona’s library and are not composed uniquely for you. The same recording can be picked for other members, who will see it under their own username. A creation does not give you exclusive rights in the recording — see section 6.
We work to keep Alyona available and to improve it, and we may change, add or remove features. We don’t promise that a particular track, genre or feature will always be available.
5. Plans and billing
- Free — $0/month, 5 creations per month. Pro — $50/month, 500 creations per month. Studio — $100/month, unlimited creations and WAV downloads. Prices are in US dollars; any taxes that apply are added on top.
- Monthly allowances reset on the 1st day of each calendar month (UTC). Unused creations don’t carry over, and deleting a creation doesn’t give one back.
- Online payment isn’t available yet. To move to a paid plan, contact us at legal@alyona.io; we’ll confirm the price, billing period and payment method with you before anything is charged, and those terms will apply to your subscription.
- If you stop paying for a paid plan, your account moves back to Free. Your library stays; your allowance becomes the Free one.
- We may change prices or plan contents. For paid plans we’ll tell you in advance, and the change applies from your next billing period.
6. The music and what you may do with it
The recordings, artwork and other content in Alyona belong to Alyona or its licensors and are protected by copyright and other laws. Subject to these Terms, we give you a personal, non-exclusive, non-transferable, revocable licence to:
- stream tracks inside Alyona for your personal, non-commercial enjoyment;
- share links to tracks and profiles; and
- on the Studio plan, download tracks and play those downloads for your personal, non-commercial use.
Anything else — including selling, distributing, broadcasting, synchronising with video, uploading to other platforms, claiming authorship, registering tracks with content-ID or rights-management services, or using them commercially — needs our prior written permission. Being credited as the artist on a creation inside Alyona does not make you the author or owner of the recording.
7. What you post
You keep the rights you have in what you write in Alyona: prompts, comments, your profile and bio. You give us a worldwide, non-exclusive, royalty-free licence to host, store, display and process that content to run and improve Alyona — for example to show your creations with the prompt you wrote and to show your comments to other members. You confirm you have the right to post it.
8. Acceptable use
Don’t:
- post anything unlawful, hateful, harassing, sexually explicit involving minors, or that infringes someone else’s rights;
- impersonate others or mislead people about who you are;
- scrape, bulk-download, or copy the library, or try to get around plan limits, downloads restrictions or security measures;
- interfere with Alyona, probe it for vulnerabilities without permission, or overload it (including with automated requests);
- create multiple accounts to get more free creations, or share or sell your account.
We may remove content that breaks these rules.
9. Copyright complaints
If you believe something on Alyona infringes your copyright, follow our Copyright Policy. We act on valid notices and close the accounts of repeat infringers.
10. Suspension and closing your account
You can stop using Alyona at any time and delete your account yourself in Settings → Delete account, or ask us to by writing to legal@alyona.io. Deletion is permanent and removes your creations from your profile and library. We may suspend or close accounts that break these Terms or the law, or to protect members or Alyona, and we’ll tell you why unless the law or safety prevents it. Sections 6 (limits on use of the music), 11, 12 and 14 survive closure.
11. Disclaimers
Alyona is provided “as is” and “as available”. To the extent the law allows, we make no warranties beyond those set out in these Terms — for example, that a track will match your description, or that Alyona will be uninterrupted or error-free. Nothing in these Terms limits rights you have as a consumer that can’t be limited by contract.
12. Limitation of liability
To the extent the law allows, we aren’t liable for indirect or consequential losses, or for loss of data, profits or goodwill, and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. We don’t exclude liability that can’t be excluded by law, such as for fraud, or for death or personal injury caused by our negligence.
13. Changes to these Terms
We may update these Terms. For material changes we’ll give you notice (for example by email or in the app) before they take effect. If you keep using Alyona after that, the new Terms apply; if you don’t agree, you can close your account.
14. Governing law
These Terms are governed by the laws of the Federal Republic of Germany, and its courts have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims there.
